In 2005, the Northern Ireland Human Rights Commission decided to conduct an Investigation into how immigration officers of the, then, Immigration and Nationality Directorate arrived at the decision to recommend that individuals be detained. The Commission’s main concern was whether the deprivation of liberty was being authorised in accordance with the requirements of Article 5 of the European Convention on Human Rights.
